In most cases, when someone is arrested there is the Bail process through which an arrested suspect is allowed to pay money in exchange for his or her release. Many people may make the mistake to bail a family member or friend out of jail (temporarily) only then to not have enough money to hire an experienced Criminal Defense Lawyer who may be able to keep them out of jail (permanently).
If your first court appearance (the Arraignment) is rapidly approaching and there is no time to file a motion or to have a hearing, your attorney may accomplish getting you released on your own recognizance or reduction in bail at your first court appearance.
A Judge will consider releasing one on their own recognizance (O.R.) or reducing the bail amount after evaluating the following conditions:
- Risk of flight - not coming back for court appearances
- Long time local residence in the community
- Strong family ties to the community
- Current Employment
- Any past failures to appear in Court
- Prior Record
- The Nature of the charges pending against you
- Pose a danger to the Public
